Case Facts: A 67-year-old motorcyclist who sustained a fractured sacrum, a torn bicep tendon, and a T-11 vertebral fracture, causing hospitalization and in house rehabilitation for over three weeks. The accident occurred on April 14, 2012 when the defendant pulled her SUV into the roadway from a garage sale directly in front of the motorcyclist causing the accident.
The motorcyclist was helicoptered from the scene because of the fear of a severe head injury. Upon release, the motorcyclist underwent extensive physical therapy before being able to return to his full time employment approximately eight months after the accident.
No lost wages were sustained and the settlement on the day before trial was for pain and suffering only.
