Occupation: Plaintiff, a postal employee, was involved in a motor vehicle accident on November 4, 2011. Plaintiff was not injured while in the course of her employment.
Case Facts: The accident occurred when the defendant motorist, who was in the Hudson Valley region on business driving a rental car, was distracted while utilizing a G.P.S. device when he struck Plaintiff vehicle from behind. Plaintiff brought suit against the defendant and the employer of the defendant driver.
Plaintiff was caused to suffer a whiplash type injury that caused cervical pain leading to blurred vision as well as headaches, dizziness and other visual changes. She treated with physical therapy for several months including cognitive therapy for her visual changes.
The defendant in this case claimed that Plaintiff’s visual changes were not casually related to the motor vehicle accident.
The matter was settled prior to jury selection and Plaintiff was awarded $525,000 for pain and suffering. The case was handled by Joseph O’Connor and Kevin Harp.
